1.Our commitment
ModMage is a multi-tenant property-management platform — a web app at https://app.modmage.io, plus the ModMage mobile apps — designed and marketed exclusively for business use by adults. Our users are landlords, property owners, property-management companies, leasing staff, vendors, and adult residents who rent or occupy a unit. The Services are not designed for, directed to, or marketed to children.
We take the privacy of minors seriously. Because operating or living under a lease, paying rent, signing agreements, and managing a property are inherently adult activities, we structure our product so that there is no reason for a child to create an account or interact directly with ModMage. This notice supplements our general Privacy Policy and should be read alongside it.
In short: ModMage is for adults. We do not knowingly collect personal information from children, and we have no features intended to appeal to or be used by children.
2.Minimum age
You must be at least 18 years old — or the age of legal majority in your jurisdiction, if higher — to register for, hold, or use a ModMage account. This requirement is set out in our Terms of Service and our End User License Agreement, and it applies to every account type, whether you join as a property manager, an owner, a vendor, or a resident.
- The Services are not offered to, and may not be used by, children under 16 under any circumstances.
- By creating an account or accepting an invitation to join a workspace, you represent that you meet the minimum-age requirement.
- We may suspend or terminate any account if we reasonably believe the account holder does not meet the minimum age.
3.No collection from children
We do not knowingly collect, solicit, or maintain personal information from children. Our sign-up flows, marketing pages, in-app experiences, and notifications are written for and aimed at adult professionals and residents. ModMage contains no games, cartoons, child-oriented content, or other features designed to attract children.
We do not use age-gated advertising, and we do not knowingly serve interest-based advertising to minors. For details on the categories of information we collect from our adult users and how we use it, see our Privacy Policy and our Cookie Notice.
4.COPPA (United States)
The U.S. Children's Online Privacy Protection Act (COPPA) and its implementing rules govern the online collection of personal information from children under 13 years of age. ModMage is not a website or online service directed to children under 13, and we do not knowingly collect personal information from children under 13.
If we discover that we have collected personal information from a child under 13 without verifiable parental consent, we will delete that information from our records as quickly as is reasonably practicable. If you are a parent or guardian and you believe your child under 13 has provided personal information to us, please contact us at privacy@modmage.io so we can investigate and remove it.
5.EEA and UK age of consent
In the European Economic Area (EEA) and the United Kingdom, the General Data Protection Regulation (GDPR) and the UK GDPR set a "digital age of consent" for information-society services offered directly to children. This age ranges from 13 to 16 depending on the country, with the UK applying an age of 13.
Because ModMage is a business service intended only for adults, we do not knowingly process the personal data of any child below the applicable digital age of consent in their country. We do not rely on a child's consent as a lawful basis for processing, and we do not offer the Services directly to children. If we become aware that we have processed the personal data of a minor below the applicable age without an appropriate lawful basis, we will delete that data without undue delay.
6.Resident and household data
Property managers and owners use ModMage to manage tenancies, and in doing so they may store household and lease information — for example, the names of authorized occupants listed on a lease, household composition fields, or emergency-contact details. In some tenancies, a household may include minors.
When a customer enters this kind of information, the customer is the data controller for that data and ModMage acts as a processor on the customer's behalf, as described in our Data Processing Addendum. We provide the platform; we do not direct what household details a customer chooses to record. Accordingly, customers agree to the following.
- Do not upload information about minors beyond what is lawful, relevant, and genuinely necessary for the tenancy — for example, the fact that a minor is an authorized occupant under a lease.
- Never create ModMage accounts or login credentials for minors, and never invite a minor to use the Services.
- Maintain an appropriate lawful basis and any required notices or consents for the personal data of household members, including minors, that you process through the Services.
- Comply with our Acceptable Use Policy and applicable law when handling sensitive data about any individual.
As the controller of resident and household data, the customer is responsible for ensuring that any information about minors is collected and used lawfully. If you have questions about your obligations, contact our data protection team at dpo@modmage.io.
7.Parents and guardians
If you are a parent or legal guardian and you believe a child has provided personal information directly to ModMage, or that a child's information has been stored in our Services without an appropriate basis, you can ask us to review and delete it. Please email privacy@modmage.io with enough detail for us to locate the information — for example, the name of the property or workspace, the type of information, and your relationship to the child.
Where the information was entered by one of our customers acting as the data controller (for example, a property manager who recorded household details), we may need to coordinate with that customer to action your request, and we may refer you to them as the controller. We will, however, always promptly remove any information that we collected directly from a child in violation of this notice.
8.Deletion of children's data
If we learn that we have collected personal information from a child in a manner inconsistent with this notice, we will delete it promptly using commercially reasonable measures, and we will close any account that was opened by or for a minor. Where information sits inside a customer workspace, we will work with the responsible customer to ensure it is removed or corrected.
Adult users who wish to remove their own account and associated data can do so as described on our Account Deletion page. For more on how long we retain information and how we safeguard it, see our Privacy Policy and our Security overview.
9.Changes to this notice
We may update this Children's Privacy notice from time to time to reflect changes in our practices, our Services, or applicable law. When we make a material change, we will revise the "Last updated" date shown at the top of this page and, where appropriate, provide additional notice through the Services or by email.
We encourage you to review this notice periodically. Your continued use of ModMage after an update takes effect means you accept the revised notice.
10.Contact us
