Acceptable Use Policy

These are the rules for acceptable use of ModMage. This policy is part of, and is incorporated into, our Terms of Service — using the Services means you agree to follow it.

1.Overview

This Acceptable Use Policy (the “AUP”) governs how you may use ModMage — our website at https://modmage.io, the web application at https://app.modmage.io, and our iOS and Android apps (together, the “Services”). It applies to everyone who accesses the Services, including account customers (landlords, property managers, and their staff), the residents and applicants they invite, and anyone else who interacts with our platform.

The AUP supplements and is incorporated into our Terms of Service. Capitalized terms that are not defined here have the meaning given to them in the Terms. Where this policy and the Terms appear to conflict on a question of acceptable conduct, the more restrictive provision controls.

Violating this policy — or helping or encouraging anyone else to do so — may result in suspension or termination of your account or access, removal of content, and other action described in Section 8. We may take these steps with or without prior notice where we reasonably believe it is necessary to protect the Services, our users, or third parties.

2.Prohibited activities

You may not use the Services to engage in, facilitate, or promote any of the following. This list is illustrative, not exhaustive.

  • Illegal activity — anything that violates applicable local, state, national, or international law, regulation, or court order.
  • Housing and consumer-protection violations — conduct that breaches fair-housing, anti-discrimination, tenant-screening, fair-credit-reporting, debt-collection, or other consumer-protection laws.
  • Fraud or misrepresentation — deceptive listings, falsified leases or financial records, phishing, payment fraud, or any attempt to obtain money, property, or data under false pretenses.
  • Harassment and abuse — harassing, threatening, stalking, or intimidating others, or posting hateful, defamatory, or abusive content.
  • Intellectual-property infringement — uploading, sharing, or distributing content that infringes copyrights, trademarks, trade secrets, or other proprietary rights.
  • Malware and harmful code — uploading or transmitting viruses, worms, ransomware, or any code designed to disrupt, damage, or gain unauthorized access to systems or data.
  • Impersonation — pretending to be another person, company, or ModMage, or misrepresenting your affiliation with anyone.

3.Fair housing and tenant rights

ModMage is used to advertise units, screen applicants, execute leases, and communicate with residents — activities that are heavily regulated. As a customer, you are solely responsible for complying with all applicable fair-housing and anti-discrimination laws, including the U.S. Fair Housing Act, state and local fair-housing statutes, the Fair Credit Reporting Act, and equivalent laws in your jurisdiction.

You must not use any ModMage feature — including listings, application forms, screening, automated workflows, or messaging — to discriminate against any person or to express any preference, limitation, or discrimination based on race, color, religion, national origin, sex, familial status, disability, sexual orientation, gender identity, source of income, or any other characteristic protected by law.

Our screening and decision-support tools are provided to help you run a fair, consistent process. They are not a substitute for legal advice and must never be used to evade fair-housing obligations. Apply your criteria uniformly, keep records of your decisions, and consult counsel where you are unsure.

4.Security restrictions

To keep the Services safe and reliable for everyone, you may not, and may not permit anyone else to:

  • Access, or attempt to access, any account, data, system, or network that you are not authorized to use.
  • Probe, scan, or test the vulnerability of the Services, or breach or circumvent any authentication, security, or access-control measure.
  • Scrape, crawl, harvest, or use automated means to extract data from the Services except through interfaces we expressly provide for that purpose.
  • Reverse engineer, decompile, or disassemble any part of the Services, or attempt to derive source code, except to the extent applicable law prohibits this restriction.
  • Circumvent or exceed rate limits, usage quotas, storage limits, or other technical or contractual restrictions.
  • Interfere with, disrupt, or place an undue burden on the Services or the servers and networks that support them.

5.Messaging and communications

ModMage lets you email and text residents, applicants, and team members. When you send communications through the Services, you are the sender and you are responsible for their content and for having a lawful basis to send them.

  • Consent and lawful basis — you must have a valid lawful basis or the recipient's consent before messaging them, and you must only contact people in connection with a genuine property-management relationship.
  • Comply with messaging laws — your email and SMS campaigns must comply with the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), CASL, and other applicable anti-spam and telemarketing laws.
  • Honor opt-outs — include accurate sender information and a working way to unsubscribe, and promptly stop messaging anyone who opts out.
  • No unsolicited bulk messaging — do not use the Services to send spam, chain messages, or unsolicited bulk email or texts.

ModMage provides the messaging tools but is not responsible for the content of communications you send. You will indemnify us against claims arising from your messaging in accordance with the Terms of Service.

6.Data responsibilities

You are responsible for the data you upload to or process through the Services, and for the people whose information it concerns.

  • Only upload data that you are authorized to collect, use, and share, and only for legitimate property-management purposes.
  • Protect resident and applicant data — limit access to authorized staff, use strong credentials, and promptly remove access for people who leave your organization.
  • Do not upload special categories of data (such as health, biometric, or precise government-identifier data) unless the Services expressly support that data type and you have a lawful basis to do so.
  • Provide the privacy notices and obtain the consents that your residents and applicants are entitled to under applicable law.

Our handling of personal information is described in the Privacy Policy, and the terms on which we process customer data on your behalf are set out in our Data Processing Addendum.

7.Service integrity

The Services are shared infrastructure, and excessive or abusive use degrades the experience for other customers. You may not:

  • Place an excessive load on the Services, including through automated request floods, runaway integrations, or denial-of-service attacks.
  • Use the Services, or any compute or storage we provide, for cryptocurrency mining or other resource-intensive activity unrelated to property management.
  • Use the Services to send unsolicited bulk messages or to store, host, or distribute malicious, deceptive, or unlawful content.
  • Resell, sublicense, or provide the Services to third parties except as expressly permitted in the Terms.

We may apply reasonable technical limits and fair-use thresholds to protect the integrity and availability of the Services. Conduct that you would expect to be off-limits generally is — when in doubt, ask support.

8.Enforcement

When we become aware of a suspected violation of this policy, we may take any action we consider appropriate, including:

  • Investigating the suspected violation and reviewing relevant content and activity.
  • Removing, disabling, or restricting access to content that violates this policy.
  • Throttling, rate-limiting, or temporarily restricting features or access.
  • Suspending or terminating an account, workspace, or individual user's access, with or without notice depending on severity.
  • Reporting suspected illegal activity to law enforcement or other authorities and cooperating with their investigations.

We will use reasonable judgment and, where practical and appropriate, give you an opportunity to address the issue. However, we may act immediately where we believe there is a risk of harm, legal exposure, or disruption to the Services. Our decision not to enforce a provision on one occasion does not waive our right to enforce it later.

9.Reporting abuse

If you believe someone is using the Services in violation of this policy, please tell us. Report suspected abuse to abuse@modmage.io and include as much of the following as you can:

  • A description of the conduct or content and why you believe it violates this policy.
  • Where you encountered it — the relevant URL, account name, workspace, listing, or message details.
  • The date and time you observed it, including your time zone.
  • Any screenshots, message copies, or other evidence that help us investigate.
  • How we can reach you if we need more information.

To report content that infringes your intellectual-property rights, please use the notice procedure in our Terms of Service. For security vulnerabilities, email security@modmage.io. See also our Acceptable Use Policy for the full list of prohibited conduct.

10.Changes to this policy

We may update this AUP from time to time to reflect new features, legal requirements, or evolving threats. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app or by email. Your continued use of the Services after an update takes effect means you accept the revised policy. If you do not agree to the changes, you must stop using the Services.
